Texas House Bill HB3399 was introduced originally on February 26th as part of a nationwide ban on gender-affirming care for minors, and it was sneakily amended to change all instances of the word “child” to “person”, which would include adults in its scope. If this bill passes, all medically assisted transitions would be banned starting on September 1st, 2025.
An excerpt from the amended bill:
“PROHIBITED PROVISION OF GENDER TRANSITIONING AND GENDER REASSIGNMENT PROCEDURES AND TREATMENTS FOR CERTAIN CHILDREN For the purpose of transitioning a person’s child’s biological sex as determined by the sex organs, chromosomes, and endogenous profiles of the person [child] or affirming the person’s child’s perception of the person’s child’s sex if that perception is inconsistent with the person’s child’s biological sex, a physician or health care provider may not […] (2) perform a mastectomy; (3) provide, prescribe, administer, or dispense (A) puberty suppression or blocking prescription drugs […] (B) […] testosterone to females; or (C) […]estrogen to males.”

This is terrifying and an abuse of power from the current republicans in power, but it was also not unexpected. It was very clearly never about protecting children. The Trump administration has in just over one month given ten executive orders targeting transgender rights, not to mention the 614 bills under consideration that would negatively impact trans and gender non-conforming people. The scariest part is the precedent: Texas has the most anti-trans legislation in the country, with 15 more bills than the second place (Missouri), and 45 more bills than third place (Oklahoma). These bills have historically seen success in Texas, as it was the first state to ban gender marker changes on Driver’s Licenses just this past August, prior to the president’s nationwide ban on January 20th, 2025.
